PROSEC and Rule Eight: Common Mistakes

PROSEC and Rule Eight can be relevant tools for companies that import inputs, parts, components, or goods linked to production processes.

But, like any foreign trade benefit, their use must be properly supported.

The risk is not only failing to have an authorization. The risk may also be using an authorization incorrectly, applying the benefit outside its scope, or lacking sufficient documentation to justify it.

  • The use or destination.
  • The production process.
  • The final product.

  • The operation declared in the pedimento.

Common mistakes

Some frequent mistakes include:

  • Using an authorization without confirming whether it remains valid.
  • Importing goods that do not correspond to the authorized sector.
  • Failing to document the use or destination of the inputs.
  • Not linking the imported goods to the production process.
  • Applying benefits out of habit, without validating current conditions.
  • Failing to preserve technical or documentary support.
  • Depending entirely on the customs broker to validate the benefit.
  • Not reviewing whether the tariff classification used is correct.
  • Not keeping an internal file per operation.

These mistakes may generate differences in duties, observations, or contingencies during a review.

The correct question

It is not enough to ask: Do we have PROSEC or Rule Eight?

The correct question is: Can we demonstrate that each operation imported under that benefit complies with the applicable conditions?

That difference is critical.

An authorization may exist, but if the operation is not properly documented, the benefit may be challenged.
